1. Definitions

The following terms are used throughout this document with the meanings given below.

"ArtRewards", "we", "us", or "our" means ARTREWARDS, ONLINE ART GALLERY, the legal entity operating the platform at www.artrewards.net.
"Platform" means the ArtRewards website at www.artrewards.net and all services, features, tools, and content available through it.
"User" means any individual or organisation that accesses or uses the Platform in any capacity, including as a visitor, registered buyer, or registered seller.
"Buyer" means a User who purchases or seeks to purchase artwork through the Platform.
"Seller" means an artist, gallery, or other art professional who has been approved to list and sell works through the Platform.
"Artwork" or "Work" means any original painting, drawing, print, photograph, sculpture, mixed-media piece, or other creative work listed for sale on the Platform.
"Listing" means a seller's published page on the Platform describing an Artwork offered for sale, including its images, description, dimensions, medium, edition details, condition, and price.
"Order" means a completed transaction initiated through our secure checkout by a Buyer.
"Order Confirmation" means the email we send to confirm that a binding sale has been formed.
"Offer" means a price proposal submitted by a Buyer on an eligible Listing below the stated asking price.
"Commission" or "Custom Work" means an Artwork produced to a Buyer's specification under a separate written agreement.
"Certificate of Authenticity" or "COA" means the signed documentation confirming an Artwork's authorship, medium, dimensions, and edition details.
"Buyer Protection Guarantee" means our published policy governing the protections ArtRewards extends to Buyers on eligible purchases.
"Stripe" means our third-party payment processor, Stripe Payments Europe, Limited.

2. Who We Are

ArtRewards is a curated online marketplace for original art, connecting collectors and enthusiasts worldwide with established and emerging artists. We are operated by:

3. Scope and Acceptance of Terms

These Terms of Service (the "Terms") govern your access to and use of the Platform and all transactions entered into through it.

By accessing or using the Platform in any way, including browsing, registering an account, making a purchase, or submitting an application to sell, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

These Terms apply to all visitors, registered Buyers, registered Sellers, and any other person who interacts with ArtRewards in any capacity.

These Terms should be read alongside the following documents, each of which forms part of the agreement between you and ArtRewards:

Where there is a conflict between these Terms and any of the above documents, these Terms take precedence unless the relevant document expressly states otherwise.

4. Changes to These Terms

We may update these Terms at any time to reflect changes in our services, legal requirements, or operational practices. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify registered Users by email.

Your continued use of the Platform after any changes take effect constitutes your acceptance of the updated Terms. If you do not accept a change, you should stop using the Platform and, where applicable, close your account. We encourage all Users to review these Terms periodically.

5. Eligibility

To use the Platform and make purchases, you must:

Be at least 18 years of age
Have the legal capacity to enter into a binding contract in your jurisdiction
Not be subject to any legal prohibition on receiving our services under applicable laws, export controls, or sanctions regimes

By using the Platform, you confirm that you meet these requirements. If you are acting on behalf of a business or organisation, you confirm that you have the authority to bind that entity to these Terms, and references to "you" include that entity.

6. Account Registration and Security

Certain features of the Platform require a registered account. When you register, you agree to:

Provide accurate, complete, and current information, including your legal name, contact details, and any other information requested during registration
Update your account information promptly if it changes
Keep your login credentials, including your password, strictly confidential
Not share your account access with any third party
Notify us immediately at info@artrewards.net if you become aware of any unauthorised access to or use of your account

You are responsible for all activity that takes place under your account, whether or not carried out by you. ArtRewards is not liable for any loss or damage resulting from unauthorised account use where you have not taken reasonable steps to protect your credentials.

We reserve the right to suspend or terminate any account that contains inaccurate information, engages in prohibited conduct, or otherwise violates these Terms.

7. ArtRewards' Role as a Marketplace

ArtRewards operates as a curated marketplace that facilitates transactions between Buyers and Sellers. In most transactions, the legal contract of sale is formed directly between the Buyer and the Seller. ArtRewards is not the seller of record in every transaction but acts as the platform through which each sale is initiated, facilitated, and supported.
